These terms apply to your use of ainaforce.com and any information you submit to ʻĀina Force (“ʻĀina Force,” “we,” “us”). By using the site, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site.
What this site is
ʻĀina Force is developing a cesspool conversion program for Hawaiʻi Island homeowners. The site provides general information and lets you tell us about your property so we can evaluate it and contact you. Submitting a property, partner inquiry, or job application is free and does not create any obligation for you or for us.
ʻĀina Force helps homeowners navigate cesspool conversion by coordinating information, introductions, documentation, and communication. Engineering, permitting, installation, and inspections are performed under separate agreements by appropriately licensed independent professionals and contractors. ʻĀina Force does not itself perform engineering or construction work, and is not a party to the agreements between homeowners and those professionals.
No guarantees about the program, funding, or results
- Adding a property does not mean it has been accepted into a pilot or program, and it is not a quote, contract, or offer of service. Any engineering or construction work would be covered by a separate written agreement between you and the licensed professional performing it.
- We do not promise installation outcomes, code compliance, or warranties; those are the responsibility of the licensed professionals you contract with. Funding, financial assistance, eligibility, approval, permitting, pricing, schedules, and installation are not guaranteed and depend on program rules, property conditions, engineering, and agency approval.
- We may decide which properties to review or invite for a site visit, in our discretion.
Information on the site is not professional advice
Content on the site — including laws, deadlines, costs, funding programs, and FAQ answers — is general information that may change and may not reflect your situation. It is not legal, engineering, tax, or financial advice. Check requirements with the Hawaiʻi Department of Health, the County of Hawaiʻi, and qualified professionals before making decisions.
Property lookups and priority areas
Parcel details (such as TMK and acreage) and State cesspool priority areas shown on the site come from public map and government data provided by third parties. They are for general information only, may be inaccurate, incomplete, or out of date, and are not an official determination. A priority area does not by itself create a deadline or requirement beyond what the law provides.
What you submit
- You agree that the information you provide is accurate to the best of your knowledge, and that you are the property owner or are authorized by the owner to share information about the property.
- You keep ownership of the photos and notes you submit. You give ʻĀina Force permission to use, copy, and share them with our project partners and relevant agencies to evaluate your property and run the program, as described in our Privacy Policy. We will not use your photos publicly without your separate permission.
- Do not submit anything unlawful, misleading, or that you do not have the right to share, and do not include other people’s personal information without their permission.
Communications
By submitting your contact details, you agree that we may contact you by email, phone, or text message about your submission and our program, as described in the Privacy Policy. Message and data rates may apply. You can unsubscribe from marketing email at any time and reply STOP to opt out of texts.
Acceptable use
Do not misuse the site: no automated scraping or bulk submissions, no attempts to access accounts or systems you are not authorized to use, no interfering with the site’s operation, and no using it for any unlawful purpose.
Our content
The site’s text, design, logos, and photos belong to ʻĀina Force or our licensors. You may view and share pages for personal, non-commercial purposes, but may not copy or reuse our content or branding commercially without permission.
Other websites
The site links to government and third-party websites. We are not responsible for their content or practices.
Disclaimers
The site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows. We do not promise that the site will always be available or error-free.
Limitation of liability
To the fullest extent the law allows, ʻĀina Force will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the site or reliance on its content. Our total liability for any claim relating to the site will not exceed one hundred dollars ($100). Some laws do not allow these limits, so they may not all apply to you.
Indemnity
You agree to defend and hold ʻĀina Force harmless from claims arising from information you submit that you did not have the right to share, or from your misuse of the site.
Governing law
These terms are governed by the laws of the State of Hawaiʻi, without regard to conflict-of-law rules. Any dispute relating to the site will be brought in the state or federal courts located in Hawaiʻi, and you and we consent to their jurisdiction.
Changes
We may update these terms from time to time by posting a new version here with a new effective date. Continuing to use the site after a change means you accept the updated terms. If any part of these terms is found unenforceable, the rest remains in effect.
